Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of 4SD (the "Service"), a multi-device WhatsApp, SMS, and voice call messaging gateway. By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Your account

You must provide accurate registration information and keep your login credentials confidential. You are responsible for all activity that happens under your account, including through any team members or sub-users you invite. Notify us immediately if you believe your account has been accessed without authorization.

2. Acceptable use

You agree not to use the Service to send unsolicited bulk messages to recipients who have not consented to receive them, to send content that is illegal, defamatory, obscene, threatening, or harassing, to impersonate any person or organization, or to attempt to circumvent WhatsApp's, any SMS carrier's, or any voice provider's own terms of service, rate limits, or anti-spam systems. We may suspend or terminate accounts that violate this section without prior notice, at our reasonable discretion.

You are solely responsible for obtaining any consent required by law (including but not limited to opt-in consent for marketing messages) before sending messages, SMS, or voice calls to a recipient through the Service.

3. Connected numbers and third-party channels

WhatsApp connectivity is provided by linking your own WhatsApp account, in a manner similar to WhatsApp Web/Linked Devices. We do not control WhatsApp's, any SMS carrier's, or any voice provider's own policies, and a connected number or gateway may be limited, rate-limited, or blocked by that third party at its own discretion, for reasons outside our control. We are not responsible for losses arising from such third-party actions.

4. Billing and wallet balance

Certain features are billed against your account's wallet balance, which you fund by purchasing a Pack, redeeming a Voucher, or topping up directly. Wallet balance is deducted at the rates displayed in the Service at the time of sending. Unused wallet balance does not expire unless stated otherwise on the Pricing page or in your specific plan. 5. Self-hosted and custom gateway features

If you choose to run the sending engine on your own server or hardware ("self-hosted" mode), or connect your own SMS/Voice gateway hardware, you are responsible for the security, uptime, legal compliance, and proper configuration of that infrastructure. We provide the connector software as-is for this purpose.

6. Intellectual property

The Service, including its software, design, and branding, is owned by us or our licensors and is protected by applicable intellectual property laws. These Terms do not grant you any right to our trademarks or branding beyond what is necessary to use the Service normally.

7. Disclaimers and limitation of liability

The Service is provided "as is" and "as available," without warranties of any kind, to the maximum extent permitted by law. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost messages, arising from your use of the Service, including any downtime, message delivery failure, or third-party channel restriction.

8. Termination

You may stop using the Service at any time. We may suspend or terminate your access for violation of these Terms, non-payment, or suspected fraudulent or abusive activity, with notice where reasonably possible.

9. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after an update constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
